Supreme Court Makes Ruling on Wine Shipments
May 16, 2005 After a decade of legal manuevering, the US Supreme Court issued a ruling today that indicated that individual states did not have the right under the 21st Amendement to the Constitution to discriminate against out of state wineries by prohibiting direct shipment of wine, while allowing in- state wineries to ship wine directly to that states residents. The Commerce Clause, which mandates the free flow of goods and services across state lines was the legal device supported by the Justices.

The ruling from the Supreme Court did not however dissolve the 21st amendment which gives each state the right to govern the sale of alcohol. As a result, each state still has the right to control the flow of wine into its state. Judging from the wording of the decision, it appears that the Justices are saying that while states can't bar direct shipment of wine to consumers, their right to legislate how those direct shipments happen, under the 21 Amendment, has been upheld.

At first glance some may say that this ruling does nothing but reaffirm each states right to govern how alcohol is shipped into their state. However this ruling does give legal leverage to those who seek to insure that states do not erect unreasonable barriers to entry for out of state wineries...such as New York's stipulation that out of state wineries have to establish a physical presence in the state in order to ship directly to consumers - something no winery did in the 35 years the law has been in effect.

What does this mean for companies like YourWineService.com that ship wine from a variety of small family-run wineries directly to consumers? As with all landmark decisions, it will take time to sort out the operational implications of this ruling, and each state has the right to craft its own response.

In the near term, we do not anticipate any change in our ability to ship wine directly to consumers in 26 states. In the mid-term a few states may become easier to ship to, and a few may become more restrictive...however in the long-term we equate this moment in time with the first Yugo stuffed full of Eastern Block citizens driving over the Hungarian border in 1988...the beginning of the end of a system in place since the 1930's. Ultimately, the forces of commerce and the free flow of goods and services are as powerful as the forces of democracy and the free flow of information and individual rights.
